1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed via our online shop ganapatee.de.

2. Conclusion of Contract

The presentation of goods in the online shop does not constitute a legally binding offer but rather an invitation to place an order. By clicking the button “Buy” (or “Order with obligation to pay”), you submit a binding offer to conclude a purchase contract. The contract is concluded as soon as we confirm your order via email.

3. Prices and Currency

All prices are displayed in Euro (EUR).

Important Note regarding payment: For cryptocurrency payments, we exclusively accept SPX6900 (SPX) via the Ethereum Network. Payments are processed decentrally and securely via DePay. All prices include the applicable German statutory Value Added Tax (VAT).

4. Payment

The following payment methods are available:

4.1 Bank Transfer / SEPA Payment in advance.

4.2 Payment via Cryptocurrency (SPX6900)

  • Accepted Currency: We exclusively accept the token SPX6900 (SPX) on the Ethereum Network (ERC-20). Payments sent via other networks (e.g., Solana, Base) or in other currencies cannot be processed and may result in the loss of funds.
  • Processing: Payment processing is decentralized and automated via the DePay protocol.
  • Privacy & Security: Due to the technical nature of blockchains, transactions are publicly visible. At no time do we have access to your private keys or wallet credentials.
  • Fees: Applicable network fees (Gas Fees) of the Ethereum Network are to be borne by the buyer.

4.3 Credit Cards & Digital Wallets We accept the following providers:

  • Google Pay / Apple Pay (where available)
  • Credit Cards (Visa, Mastercard, American Express)
  • PayPal

5. Delivery and Shipping

We deliver:

  • Within Germany
  • To all EU countries
  • Worldwide (e.g., USA, Canada, Australia)

Delivery times are indicated on the respective product page.

5.1 Shipping Costs Shipping costs are displayed at checkout.

5.2 Customs and Import Duties (Non-EU) For deliveries to countries outside the EU, additional fees (e.g., customs duties or taxes) may apply. These costs are to be borne by the buyer and may vary depending on the product. Please refer to the specific notes on the individual product page.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Right of Withdrawal

The statutory right of withdrawal of 14 days applies. The complete cancellation policy can be found under Cancellation Policy (Widerrufsbelehrung).

Exclusion of the Right of Withdrawal: There is no right of withdrawal for individually made rugs (custom-made products) (§ 312g Abs. 2 Nr. 1 BGB).

8. Return Costs

In the event of defective, damaged, or incorrect goods, we will bear the return shipping costs. For returns for other reasons, the buyer bears the direct cost of returning the goods.

9. Nature of the Goods

Our rugs are:

  • Hand-knotted
  • Made from natural materials (wool, silk)
  • Individually unique in color and structure

Therefore, deviations in color, pattern, size, or structure may occur. This is typical for handcrafted products and does not constitute a defect. Digital or computer-generated product images serve as illustrations only.

10. Liability

We are liable without limitation in cases of:

  • Intent or gross negligence
  • Injury to life, body, or health
  • Claims under the Product Liability Act (Produkthaftungsgesetz)

In cases of slight negligence, we are only liable for the breach of essential contractual obligations, limited to the foreseeable damage typical for the contract.

11. Data Protection

Our data protection regulations can be found under Privacy Policy (Datenschutzerklärung).

12. Dispute Resolution

The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/ We are not obliged and not willing to participate in dispute settlement proceedings before a consumer arbitration board.

13. Jurisdiction and Applicable Law

German law applies exclusively. The place of jurisdiction for merchants is Frankfurt am Main.
