Terms & Conditions (T&C)

1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed by consumers or businesses through our online shop at ganapatee.de.

Contractual Partner:

Ganapatee Fairtrades UG (haftungsbeschränkt)
Danziger Straße 2
61440 Oberursel
Germany
Email: fairtrades@ganapatee.de

2. Conclusion of the Contract

The presentation of products in our online shop does not constitute a legally binding offer but rather an invitation to place an order.

By clicking the “Buy” or “Place Order with Obligation to Pay” button, you submit a binding offer to conclude a purchase contract for the goods contained in your shopping cart.

The purchase contract is concluded once we accept your order by sending you a corresponding confirmation email.

3. Prices and Currency

All prices are stated in euros (EUR) and include German statutory VAT, where VAT is applicable.

For cryptocurrency payments, we exclusively accept SPX6900 (SPX) via the Ethereum network (ERC-20).

Cryptocurrency payments are processed through the payment service provider DePay.

4. Payment Terms

The following payment methods are available:

4.1 Bank Transfer / Advance Payment (SEPA)

The goods will be shipped after full payment has been received.

4.2 Payment by Cryptocurrency (SPX6900)

We exclusively accept the SPX6900 (SPX) token on the Ethereum network (ERC-20).

Payments sent through other networks or using other cryptocurrencies cannot be processed.

Payment processing is carried out through the DePay payment service provider.

Due to the technical characteristics of blockchain networks, transactions are publicly visible. We do not store our customers’ private keys or wallet access credentials.

Any network fees charged by the Ethereum network are generally borne by the buyer, unless otherwise stated during the ordering process.

4.3 Credit Cards and Digital Payment Methods

Where available, the following payment methods may be offered:

  • Visa
  • Mastercard
  • American Express
  • PayPal
  • Google Pay
  • Apple Pay

The payment methods actually available are displayed during the checkout process.

5. Delivery and Shipping

We deliver within Germany, to member states of the European Union and, where offered during the ordering process, to other countries.

The applicable delivery times are stated on the respective product page or during the ordering process.

5.1 Shipping Costs

Any applicable shipping costs are displayed during the checkout process.

5.2 Customs Duties and Import Charges

For deliveries to countries outside the European Union, additional customs duties, import charges or other fees may apply.

Where such costs arise and are legally payable by the buyer, they shall be borne by the buyer.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Statutory Right of Withdrawal

Consumers generally have a statutory right of withdrawal of 14 days.

The complete withdrawal policy can be found under the “Right of Withdrawal” section of our website.

The right of withdrawal does not apply to contracts concerning goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the consumer’s personal requirements, particularly individually made carpets.

The statutory right of withdrawal generally continues to apply to regularly offered products that are not individually manufactured.

8. Return Shipping Costs

In the event of a justified return due to a defect, damage or incorrect delivery, we shall bear the applicable return shipping costs where we are responsible for the issue.

For returns made under the statutory right of withdrawal, the consumer shall bear the direct costs of returning the goods, provided that we have properly informed the consumer of this obligation before conclusion of the contract.

9. Characteristics of the Goods

Our carpets are handmade.

Depending on the product, different materials are used, in particular wool, silk or other fibres specified in the respective product description.

Due to the handcrafted nature of the products, minor variations in colour, pattern, size, structure, knotting and surface may occur.

Such variations may be characteristic features of handmade products and do not, by themselves, constitute a defect.

For digitally displayed or computer-generated designs, there may also be minor differences between the representation on the screen and the finished product.

The agreed characteristics of the goods are determined by the information provided in the respective product description and by any characteristics individually agreed with the customer.

10. Statutory Warranty Rights

The consumer’s statutory rights in the event of defects in the goods remain unaffected.

Statutory warranty rights apply independently of any voluntary commercial guarantee that may be offered.

Where a voluntary guarantee is offered, its scope and conditions are set out in the respective guarantee statement.

11. Liability

We shall be fully liable for damage caused by intentional or grossly negligent conduct, as well as for damage resulting from injury to life, body or health.

In the event of slightly negligent breach of material contractual obligations, our liability shall be limited to the foreseeable damage that is typical for the contract.

Liability under mandatory provisions of the German Product Liability Act remains unaffected.

12. Data Protection

Our Privacy Policy provides information about the processing of personal data and can be accessed through the corresponding section of our website.

13. Dispute Resolution

We are neither willing nor legally obliged to participate in dispute resolution proceedings before a consumer arbitration board.

14. Applicable Law and Jurisdiction

German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law shall apply only insofar as it does not restrict the protection provided by mandatory provisions of the law of the country in which the consumer has their habitual residence.

If the customer is a registered merchant (Kaufmann), the place of jurisdiction shall be Frankfurt am Main.

15. Severability Clause

Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

The applicable statutory provisions shall apply in place of the invalid provision.
